New York City criminal attorney Russ Kofman releases a new article (https://www.lebedinkofman.com/practice-areas/criminal-defense/vehicular-crimes/unlicensed-operation-of-a-vehicle/) explaining the Unlicensed Operation of a Motor Vehicle in New York. The lawyer mentions that under New York State Law, a person is guilty of unlicensed operation of a motor vehicle when they operate or drive a motor vehicle on a public highway without their license.

“A person is also guilty if he or she operates or drives a motor vehicle upon any sidewalk or to or from any lot adjacent to a public garage, supermarket, shopping center, or car washing establishment and is unlicensed. An individual may operate a vehicle without a license during the course of a New York Department of Motor Vehicles road test,” says the New York City criminal attorney.

The lawyer explains that the unlicensed operation of a motor vehicle is a traffic infraction but it may constitute a lesser offense of traffic crime or may be charged in a case with other offenses for which a jury trial may be required. To be found guilty of the crime of unlicensed operation of a motor vehicle, the prosecution must prove that the defendant operated a motor vehicle on a public highway and that the defendant did so without being duly licensed.

Attorney Russ Kofman adds that a person may be charged with aggravated unlicensed operation of a motor vehicle in the third degree when they operate a motor vehicle on a public highway while knowing or having reason to know that his or her privilege of driving or operating a motor vehicle is suspended, revoked, or withdrawn.

In the article, attorney Kofman adds that the unlicensed operation of a motor vehicle can be in the second degree if the person has been previously convicted of a DWI, or has refused to submit to a chemical test.

According to the criminal lawyer, “Under New York State law, a person is guilty of aggravated unlicensed operation of a motor vehicle in the first degree when a person operates a motor vehicle upon a public highway while knowing or having reason to know that his or her license has been suspended, revoked, or otherwise withdrawn by the commissioner.”

Lastly, attorney Kofman emphasizes the importance of having a skilled lawyer when facing charges of DWI. An experienced lawyer may be able to help the defendant understand their rights and protect their freedom.
